All software has been donated. We accept only complete
and legal software. All copies come directly from the vendor
in the original shrink wrap and are passed on to you in the
same condition. |

Support is the publisher's option, and does not differ
from that offered on commercially available versions of the
same software. |

Software may not be resold. You may give it away, consistent
with applicable licensing restrictions, but please enclose a
copy of these policies and limitations if you do. |
Limitations
on Warranties
CompuMentor is a nonprofit organization that recruits volunteers
and solicits donations of computer software for the benefit of other
nonprofit agencies. As a nonprofit itself, CompuMentor operates
with finite resources. We seek to assure that the software we provide
is useful and in working order, but we can offer no guarantees.
Specifically, we wish clients to know that we do not routinely examine
individual software packages; rather we rely on the providers' descriptions
of the software's condition.
Accordingly, it is necessary for any client utilizing CompuMentor's
services to understand and accept the element of risk involved.
Please read the formal legal language which follows. By signing
and returning a software order form you are accepting the terms
of this limitation on warranties.
By this agreement, CompuMentor is providing a service package that
may include technical assistance, the loan, sale, license or donation
of computer programs and software, or some combination of these
elements.
It is the intent of the parties to this contract to fully and completely
state the rights and obligations of the parties in this contract
and CompuMentor has specifically set forth in this contract the
extent and nature of the warranty on the goods to be donated and
sold. Therefore, it is expressly agreed that the liability of CompuMentor
will be limited to its good faith efforts to provide useful services
and goods, and there are no other warranties or representations
with respect to the nature and quality of the goods.
Any other warranty is hereby agreed to be inconsistent with the
stated warranty, and it is the intent of the parties to specifically
DISCLAIM THE WARRANTY OF MERCHANTIBILITY AND THE WARRANTY OF FITNESS.
COMPUMENTOR MAKES NO WARRANTY THAT THE GOODS AND SERVICES PROVIDED
UNDER THIS CONTRACT ARE FIT FOR ANY PARTICULAR PURPOSE.
